Throughout these Terms, “Happier With Birds,” “we,” “us,” and “our” refer to Happier With Birds. “You” and “your” refer to the person visiting our website or purchasing from us.

By accessing our website or purchasing from us, you agree to these Terms of Service and any additional policies referenced here, including our Return & Refund Policy, Shipping Policy, and Privacy Policy.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to display and sell our products.

Products purchased through this website are sold by Happier With Birds. Shopify provides the technology supporting the store but is not the seller of our products.

We make reasonable efforts to present product descriptions, photographs, colors, measurements, materials, and other details accurately.

  • Screen settings may affect how colors appear.

  • Garment dye batches may have slight color variations.

  • Product measurements may vary slightly because of manufacturing tolerances.

  • Print placement, color, and size may vary slightly between individual products.

  • Product images may include styled mockups used to demonstrate the design.

These minor differences do not normally constitute a defect. If your product is significantly different from its description or arrives with a manufacturing problem, please contact us.

We may update product descriptions, specifications, prices, and availability without prior notice.

5. Made-to-Order Products

Most products sold by Happier With Birds are produced specifically after an order is placed. We do not maintain a traditional inventory of finished products.

Because our products are made to order:

  • Production may begin shortly after checkout.

  • Changes or cancellations cannot be guaranteed once production begins.

  • Returns and exchanges for an incorrect size, color, or change of mind may not be accepted, except where required by law.

  • Personalized or custom products are subject to additional restrictions described in our Return & Refund Policy.

Please review all product details and size information before ordering.

6. Personalization and Customer Instructions

You are responsible for checking all personalization information before submitting your order, including names, spelling, capitalization, dates, colors, and other custom details.

We will generally create the product using the information exactly as you submitted it. We are not responsible for errors contained in customer-provided instructions.

We may contact you if your instructions are unclear. If we cannot obtain the information needed to complete your order within a reasonable period, we may cancel and refund the affected product.

We reserve the right to reject personalization containing:

  • Illegal or threatening material;

  • Hate speech or discriminatory content;

  • Obscene or seriously offensive material;

  • Content that infringes another person’s intellectual-property rights; or

  • Content that could expose us or our production partners to legal liability.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products under these Terms. Receiving an automated order confirmation means that we received your order, but it does not necessarily mean the order has been accepted for production.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including:

  • A product or variant becoming unavailable;

  • An obvious pricing or product-information error;

  • Suspected fraud or unauthorized payment;

  • An incomplete or undeliverable shipping address;

  • Violation of these Terms;

  • Restricted shipping destinations; or

  • Inability to produce the requested personalization.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

We may limit quantities purchased by one person, household, account, payment method, or shipping address when reasonably necessary to prevent fraud, unauthorized resale, or misuse.

8. Prices and Payments

Prices are displayed in the currency shown on the website. Prices may change without notice, but a change will not affect an order that we have already accepted unless there was an obvious pricing error.

You agree to provide accurate billing, payment, and contact information.

By submitting payment information, you confirm that:

  • You are authorized to use the selected payment method;

  • The information provided is correct; and

  • You authorize us and our payment providers to charge the total shown at checkout.

Payment processing is handled by Shopify and other authorized payment providers. We do not directly store complete payment-card information.

Discounts and promotional offers:

  • May have eligibility requirements and expiration dates;

  • Cannot be redeemed for cash;

  • May not be combined unless stated otherwise; and

  • May be withdrawn or corrected if created or applied in error.

9. Taxes, Customs, and Import Charges

Applicable taxes may be calculated and collected during checkout.

For international orders, customs duties, import taxes, handling fees, or brokerage charges may be imposed by the destination country. Unless checkout specifically states that these charges are included, the customer is responsible for paying them.

We do not control customs authorities or their processing times. Refusing a shipment because of unpaid customs or import charges may affect refund eligibility.

Nothing in this section changes any tax or pricing rights provided by applicable law.

10. Shipping and Delivery

Production and delivery estimates are provided in good faith but are not guaranteed delivery dates.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier disruptions;

  • Customs inspections;

  • Severe weather;

  • Public holidays;

  • Incorrect addresses;

  • Production delays;

  • Labor interruptions; or

  • Events of force majeure.

Customers are responsible for entering a complete and accurate delivery address. Please contact us immediately if you notice an error. We cannot guarantee address changes after production or shipment begins.

Risk of loss and legal ownership of products transfer as determined by applicable law. Nothing in these Terms removes any rights you may have when an order is lost, damaged, or not delivered.

11. Returns, Replacements, and Refunds

Returns, replacements, cancellations, and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Please contact us promptly if an item arrives damaged, defective, incomplete, or incorrect. We may require photographs or other reasonable information to investigate the problem.

Approved refunds are issued to the original payment method. Processing times may vary depending on your bank or payment provider.

Nothing in these Terms or our Return & Refund Policy limits any mandatory consumer rights that apply to your purchase.

12. Intellectual Property

Unless otherwise stated, the website and its contents—including designs, artwork, photographs, graphics, logos, text, product descriptions, page layouts, and branding—are owned by or licensed to Happier With Birds and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes.

You may not, without our written permission:

  • Copy or reproduce our artwork or product designs;

  • Download or republish website images for commercial use;

  • Manufacture or sell products using our designs;

  • Remove copyright, trademark, or ownership notices;

Purchasing a physical product does not transfer ownership of the design or other intellectual-property rights associated with that product.

If you submit a review, photograph, comment, suggestion, or other content, you confirm that:

  • You created it or have permission to share it;

  • It does not infringe another person’s rights;

  • It is truthful and relates to your genuine experience;

  • It does not contain unlawful, abusive, deceptive, or malicious material; and

  • It does not contain malware or harmful code.

You retain ownership of your content. By submitting it to us, you grant Happier With Birds a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and share that content for operating and promoting our store, subject to applicable privacy and consumer-protection laws.

We may remove content that violates these Terms, but we are not obligated to monitor every submission.

We will not knowingly alter customer reviews in a way that misrepresents the customer’s opinion.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, willful misconduct, or any consumer right that cannot legally be waived.
